Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Chroma Drop mobile application (the "Service") operated by XD Innovations ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms.

1. License to Use

XD Innovations grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly in accordance with the terms of this Agreement.

2. Virtual Currency and Purchases

The Service may include virtual currency ("Prisms") or items which may be purchased from us for real world money if you are at least 18 years old (or the age of majority in your jurisdiction).

• Virtual Currency and items constitute a limited, non-transferable, revocable license to use features of the Service.
• Unless required by law, all purchases of Virtual Currency and items are final and non-refundable.
• We reserve the right to control, regulate, change, or remove any Virtual Currency or items without any liability to you.

3. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
• Using cheats, automation software (bots), hacks, mods, or any unauthorized third-party software designed to modify the Service.
• Harassing, abusing, or harming another person or group, including employees of XD Innovations.

4. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of XD Innovations and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

5. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination.

6. Limitation of Liability

In no event shall XD Innovations, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
